Misleading as statedIncome tax

Gifting investments to relatives guarantees zero capital-gains tax.

A qualifying gift and a later sale are separate tax events. Previous-owner cost can carry over, and clubbing can attribute income back to the donor. A real transfer of ownership, recipient eligibility and cross-border rules require review.

NRIs lose up to 5% of inherited property value, and the cost is 100% avoidable.

No government basis was established for either percentage. ₹50 lakh on a ₹10 crore estate is an illustrative calculation, not a statutory fee. Ask for separately evidenced court charges, registration charges, professional fees and travel costs.

A registered will is a necessary first condition for inheritance.

Will registration is optional under Section 18(e) of the Registration Act. Valid execution, applicable personal law, proof and any dispute still matter. Registration does not guarantee that a will cannot be challenged.

ConditionalWills & inheritance

Every inherited property needs a succession certificate and relatives’ NOCs.

A succession certificate concerns debts and securities; it is not a universal title document for a house. Ask the relevant institution or local authority to identify the required document and legal basis. An NOC is not automatically required from every relative.

Check whether older probate guidance remains current.

The 2025 amending Act removed Section 213 of the Indian Succession Act. This does not erase all probate, estate-administration or dispute procedures. Ask a lawyer to apply the amendment to the relevant estate and proceedings.

An NRI property sale involves TDS, banking records and a tax return.

Plan the non-resident withholding route before the first payment. TDS is a credit against the final tax calculation, not necessarily the final liability. Confirm the permissible receipt and remittance route from the acquisition and funding history.

CGAS, a replacement home or 54EC bonds can reduce sale tax.

Each route has its own asset, amount and timing conditions. CGAS is a deposit mechanism for applicable relief, not an independent tax exemption. Eligible bond investment has a six-month window and ₹50 lakh limit; parking funds in CGAS does not extend that bond deadline.

Conditional interpretationIncome tax

UAE-resident NRIs pay no Indian capital-gains tax on mutual funds.

The treaty’s residual capital-gains clause can be relevant to qualifying fund-unit disposals. Entitlement depends on treaty residence, asset classification, applicable amendments and anti-abuse rules. The protocol alone does not settle every mutual-fund case or guarantee a refund.

The eleven listed countries all mean zero capital-gains tax.

Treaties differ, and allocation of taxing rights is separate from domestic tax in the residence country. Germany’s official guidance describes taxable investment gains. The list cannot be treated as a zero-tax eligibility chart.

New RBI fixed-deposit rules apply from 1 October 2026.

The official 21 August notice supports the 1 October implementation date for relevant rupee bulk-deposit changes. It does not justify a promise of higher returns or an assumption that every retail, NRE, NRO and FCNR deposit has identical rules. Full disclosure details remain unverified here.
